Please read through our entire third-party rental agreement below before deciding to book your reservation with one of our partners.</p> <p><a href=”/vacation-rentals/” class=”ek-link”><strong><em>Booking directly</em></strong></a><strong><em> with Island Vacations is always the safest and most secure route with the least amount of fees. Should you wish to book your stay through a third-party vendor, please be aware that you will incur additional fees from that third-party on top of Island Vacations standard security deposit & non-refundable $50+tax booking fee.</em></strong></p> <p>AVOID being scammed. We will never ask you to send money via Facebook, Paypal, Venmo or to a private individual. Always book directly with Island Vacations to ensure a positive booking experience. Be aware there are other companies with similar names – make sure to always look for our logo when making reservations online or just call us directly, toll-free, at 888-451-7277. Island Vacations is locally owned & operated and has been voted ‘Best Vacation Rental Company’ since 2017. If the terms and conditions in this agreement are not acceptable, you may contact Island Vacations to discuss or inquire.</strong></p> <p><strong>ACCURACY OF INFORMATION:</strong>  To the best of Island Vacations knowledge, the information contained on this agreement and our website is accurate, but not guaranteed.  Descriptions, rates and property amenities listed on this agreement are subject to change without notice.  Omissions, additions or errors, as well as changes in property bedding, furnishings, equipment, etc., shall not be the responsibility of Island Vacations, property owner or reserving agent.  Guests are required to check with Island Vacations about specific items of importance to them prior to booking.</p> <p><strong>RESERVATIONS MADE BY OTHERS:</strong>  All reservations made by owners, outside travel agents and/or third-party reservations services are subject to rules and policies of Island Vacations.  Island Vacations is not responsible for inaccurate or misleading representations presented by the vacation rental owner or outside travel agents.  Guests will be required to resolve any discrepancies directly with the owner of the accommodations, the third-party booking site or their travel or booking agent.</p> <p><strong>NON-REFUNDABLE RESERVATION FEE: </strong>Island vacations collects a <em>non-refundable </em>reservation fee on every booking made through our website and third-party vendors. The fee is $50 plus tax of 11%. </p> <p><strong>THIRD-PARTY BOOKING FEES & TERMS: </strong>Island Vacations is not responsible for fees outside of our reservation, cancelation or deposit amounts. Guests are held liable for any fees incurred from third-party sites such as VRBO, Flipkey,, Expedia, etc. Guests who use such third-party booking services are responsible for complying with such terms in addition to our rental agreement terms & policies. It is the responsibility of the guest to read and understand the terms and policies in effect as of the dates of occupancy of all third-parties and/or aforementioned sources, and Island Vacations does not interpret, warrant or provide any information pertaining to third party policies, rules, regulations or conditions. WE STRONGLY RECOMMEND <a href=”” class=”ek-link”>BOOKING DIRECTLY THROUGH OUR OFFICE</a> TO ENSURE THE BEST RATE AND LEAST AMOUNT OF CONFUSION ON FEES & POLICIES.</p> <p><strong>CANCELLATION POLICY:</strong> All cancellations are subject to a $100 cancellation fee.  If it is necessary to cancel, deposits and/or prepaid funds will be forfeited unless written notice of such cancellation is received at least <strong>90 days prior to your arrival</strong>. If you cancel outside 90 days from your arrival date, you will receive your funds back, less the cancellation fee.  If you cancel within 90 days, all prepaid funds will be retained until property is rebooked for the full term/rate of your reservation. </p> <p><strong>DEPOSIT:</strong> CREDIT CARDS are accepted ONLY for the initial deposit and non-refundable reservation fee. Your deposit is in addition to the rent.  It will be held for up to six (6) weeks following your departure and is subject to adjustments for missing items, damaged property, extra cleaning, extra laundry and other expenses, such as long-distance calls.  All refunds will be sent in check form, unless stated otherwise.</p> <p><strong>FINAL PAYMENT:</strong>  Final payment must be made by personal check, cashier’s check, electronic check or money order.  Checks must be payable in U.S. funds and drawn from a U.S. financial institution; otherwise, any bank fees to convert to U.S. funds will be the guest’s responsibility. <strong><em>Final payments are due 30 days prior to arrival for reservations less than 21 nights and due 60 days prior to arrival for reservations 21 nights or longer and/or gross rent of $8,000 or higher.  Make checks payable to: ISLAND VACATIONS</em></strong></p> <p><strong>NSF CHECKS:</strong>  We welcome your personal checks; however, Island Vacations will deduct from your deposit the applicable bank fees plus a $25.00 handling fee for any checks returned to us due to insufficient funds</p> <p><strong>TRIP CANCELLATION INSURANCE:</strong>  Travel insurance through Generali Global Assistance, formerly CSA Travel Protection, is made available by Island Vacations as a convenience and coverage for guests who are U.S. residents.  Island Vacations is not affiliated with Generali Global Assistance and we do not underwrite insurance either individually or with third party vendors, nor do we guarantee the accuracy or quality of their services.  Although we may promote and/or recommend the services offered by Generali Global Assistance, this is just one of many travel insurance companies in the marketplace, and guests are encouraged to research other options to find the coverage which best fits their individual needs. All guests are ultimately responsible for understanding the services they purchase and are solely responsible for understanding the exclusions, limitations and coverage. If travel insurance was included in your original confirmation and you do not wish to purchase this coverage, simply subtract this charge before making your payment.  </p> <p><strong>RENTAL OFFICE:</strong>  We are located at 1101 Periwinkle Way, suite #108, on Sanibel Island.  Our office is open Monday through Saturday, 8:30 – 4:00 PM.  All keys are to be picked up from our office. Our local phone number is 239-472-7277.</p> <p><strong>CHECK-IN:</strong> Check-in time begins at 3 PM on the day of your arrival.  Guests should not expect to take occupancy sooner than this time.  In some cases, check-in may be delayed due to circumstances beyond our control.  Rate adjustments cannot be made for late check-in or early departures</p> <p><strong>CHECK-OUT:</strong>  Check-out is prior to 10 AM.  Late check-outs are sometimes possible, but you must check with our reservations department for approval and time.  Our owners are happy to share their Florida home with you and trust you will respect it as your own.  We ask that you maintain the cleanliness of the property during your visit.  Before you depart, please remove any garbage to the receptacles provided.  We also ask that you start the dishwasher and leave no more than 3 loads of laundry for housekeeping.  KEYS MUST BE RETURNED TO OUR OFFICE. </p> <p><strong>LATE ARRIVALS</strong>:  Late arrival registrations are handled on a 24-hour basis through our KEY BOX, located at our office ground level.  </p> <p><strong>CAUSEWAY TOLL CHARGES:</strong> To reach the Islands, it is necessary to cross a Causeway to Sanibel.  A toll booth is located on the mainland side of the Causeway.  There is a $6.00 toll to enter islands.</p> <p><strong>MAXIMUM PERSON LIMIT:</strong>  The maximum number of occupants indicated on this agreement has been set by the property owner and/or association and includes small children and infants.  If you exceed this limit at any time, we will be happy to help you find additional accommodations.  VIOLATION OF THIS MAXIMUM PERSON LIMIT MAY RESULT IN IMMEDIATE REMOVAL, AND FORFEITURE OF ALL MONIES PAID.</p> <p><strong>YOUTH/STUDENT GROUPS:</strong> Individuals under the age of twenty-five (25) are not permitted to make reservations or check-in without an adult (26yo+) or older.  Any reservation obtained under false pretenses will cause the forfeiture of all amounts prepaid and guests will be asked to vacate the rental property immediately.</p> <p><strong>NO SMOKING:</strong>  All Island Vacation properties are considered non-smoking.  Smoking is only permitted outside. Some porches may not be suitable for smoking due to ventilation and proximity of rental properties nearby. Any guest who smokes inside a rental property will be asked to leave immediately, and all charges to restore the rental property back to its original condition will be charged to the guest. Designated smoking areas may be assigned by individual complexes. Check with your reservationists for details on your specific property prior to making your reservation if concerned.</p> <p><strong>HOUSE PARTIES: </strong>Island Vacations does not allow house parties in any rental property.  Guests are not allowed to organize graduations, reunions, weddings, receptions, or any other function similar in nature. </p> <p><strong>ASSOCIATION RULES:</strong>  Your accommodations are confirmed with the understanding that you will adhere to the rules and regulations set by individual condominium or homeowners associations.  You will receive a copy of these upon arrival or you are welcome to ask for a copy prior to arrival.</p> <p><strong>PARKING RESTRICTIONS:</strong> The parking areas of individual properties are for automobiles only.  Motor homes, travel trailers, boat trailers, commercial vehicles, etc. are strictly prohibited.  Please ask us prior to traveling for assistance in locating local storage for these vehicles.  Some properties require a parking permit that must be displayed in the window of the vehicle at all times.  If these rules are not followed, Island Vacations is not responsible in the event your vehicle is towed.</p> <p><strong>FURNISHINGS:</strong>  The properties rented through Island Vacations are individually owned and decorated.  Although Island Vacations requires minimum standards, the style, quality, and color schemes of properties will vary according to the individual owner’s taste.  Island Vacations does not accept liability for the aesthetic or functional perception of the rental properties’ contents and no rate adjustments can be made.  Any missing or broken items not considered normal wear and tear will be charged to the guest. </p> <p><strong>INTERNET:</strong> All of our rental properties provide high speed internet and/or wireless internet services.  It is the guest’s responsibility to ascertain if internet service will meet their individual needs. Island Vacations does not accept liability or rate rebates due to malfunction or loss of service.</p> <p><strong>PETS/SERVICE ANIMALS: </strong>  Pets are not permitted in any rental property unless otherwise specifically stated in writing.  If you would like to bring a pet, IV will make every reasonable effort to accommodate you in a pet-friendly property but cannot guarantee the availability of these units.  In all properties where pets are accepted, a non-refundable pet fee will be charged to your reservation and must adhere to rules and regulations that commercial properties must follow.  It should be noted that as of 2011, only dogs are recognized as service animals by ADA.  With that being said, we understand the difficulties of those with special needs when it comes to travel, and we will make every effort to accommodate you and your service animal, or refer you to other properties, agencies, or services who can in the unlikely event we cannot.  Emotional support animals, comfort animals, and therapy dogs are not service animals under Title ll and Title lll of ADA.  Other species of animals, whether wild or domestic, trained or untrained, are not considered service animals.  If you plan to travel with a comfort animal, we will make every reasonable effort during the normal course of business to pair you with a property where your animal is accommodated, and a non-refundable fee will be charged to your reservation.  It is important to note that the non-refundable pet fee is NOT a damage deposit.  All damages caused by any animal, whether ADA service animal, pet or therapy animal is an additional charge, and will be billed to the credit card on file.  Any reservation obtained under false pretenses will cause the forfeiture of all amounts prepaid and guests will be asked to vacate the rental property immediately. The guest’s deposit will be charged against any costs with regard to returning the rental property to its original condition.</p> <p><strong>HOUSEKEEPING:</strong>  All properties are cleaned prior to your arrival and provide fresh linens for your stay.  There is no daily maid service, but additional housekeeping services are available for a fee.  Please call us to schedule these.</p> <p><strong>MAINTENANCE:</strong>  It may be necessary to periodically close tennis courts, swimming pools, shuffleboard courts, recreation buildings, etc., for maintenance during your visit.  In the event of an equipment malfunction within a rental property, Island Vacations will expedite maintenance repairs as quickly as possible.  Should a repairman make a call to a rental property and find the equipment is not in working order due to guest misuse, oversight or neglect, the fee for the service will be charged to the guest. No rate rebate can be approved due to circumstances beyond our control or for malfunction or loss of use of equipment or amenities.  Any damages discovered requiring maintenance repairs should be reported to Island Vacations promptly.</p> <p><strong>QUIET USE AND ENJOYMENT:</strong>  Island Vacations does not guarantee quiet use or enjoyment of rental properties due to noise from other persons, neighboring properties, construction, maintenance, etc.  Island Vacations cannot grant rate adjustments resulting from circumstances outside of the rental property.</p> <p><strong>ACTS OF NATURE:</strong>  Island Vacations cannot be held liable for any acts of nature or occurrences beyond our control.  NO rate adjustments will be made.</p> <p><strong>HURRICANE POLICY:</strong> If you are traveling between the months of June 1 and November 1, please note that this is hurricane season.  We strongly encourage you to purchase trip insurance to protect your investment, as owners are not required to rebate rent in the event of a voluntary or mandatory evacuation.  For questions regarding coverage, please call our office or call CSA Travel Protection 866-999-4018.</p> <p><strong>PEST CONTROL:</strong>  Rental properties are treated for pest control by the condominium association or by a contracted pest control company.  Island Vacations will make every effort to address pest control concerns but is not responsible for rebates due to the presence of pests or in the event of untimely service by pest control companies.  Sanibel and Captiva are tropical islands and some pests are inherent to the region and climate making them resilient against professional treatment.</p> <p><strong>ENTRY OF PREMISES</strong>:  Guest agrees to allow Island Vacations employees, vendors, contractors or subcontractors access to the rental property for any reason to make repairs, improvements, care for or manage the property.</p> <p><strong>UNITS FOR SALE:</strong>  In the event that a rental property, which a guest is renting, is listed for sale, we may be asked by a realtor to show the property during the guest’s stay.  We will make every attempt to schedule the showing at a convenient time so as not to disturb your vacation.</p> <p> <strong>SUBSTITUTION OF ACCOMMODATIONS:</strong> Circumstances occasionally arise which cause confirmed properties to be unavailable.  Therefore, Island Vacations reserves the right to substitute comparable accommodations.  We cannot guarantee the confirmed rate in these instances, though the new rate will be subject to your approval.</p> <p> <strong>AMENITIES: </strong>Amenities vary at each rental property.  Please contact Island Vacations for specific needs you may have regarding rental property amenities.  Island Vacations is not liable for malfunction or closure of rental property amenities and no credits and/or discounts can be granted for circumstances beyond our control.</p> <p><strong>POOLS/SPAS:</strong>  Swimming pools are normally heated to 78 degrees from December 15 to April 15.  The temperature settings and hours of usage are controlled by the owners or the association.  Not all properties have pools.  Island Vacations is not responsible for pool or spa temperatures, closures or malfunctions.  No credit, discount and/or rate adjustments can be granted for items mentioned above or circumstances beyond our control.</p> <p> <strong>TENNIS:</strong>  Allocation of tennis court times and court rules are set by the owners or the association.  Not all properties have tennis courts.</p> <p><strong>TELEPHONE USAGE:</strong>  All properties are equipped with telephones for your use.  There is no charge for local calls.  Please use a credit card or calling card for all long-distance calls.  If you do charge calls to the local number, there is a minimum handling fee of $1.00 per call plus the applicable charge from the phone company.</p> <p> <strong>LOST ITEMS:</strong> Island Vacations is not responsible for any items left in a property.  If items are found and returned to our office, we will gladly ship them back, but the guest is responsible for the expense of shipping and handling. </p> <p> <strong>MISCELLANEOUS CHARGES:</strong>  A charge of $10.00 will be deducted from your deposit for each key not returned to Island Vacations upon your departure.  The charge for a departure after 10:00 a.m. is one extra day’s rate, unless a later check-out time has been previously approved by Island Vacations.  There is a $30.00 charge for key delivery if keys are locked in the apartment or lost during business hours.  After business hours Island Vacations has an “on-call” person who can assist guests to obtain an emergency key if guest can physically make it to the office. Otherwise, guests are responsible for cost of locksmith in the event lockout occurs when Island Vacations is closed.</p> <p> <strong>MAIL:</strong> Please arrange to have any mail you will be receiving sent to you, in care of Island Vacations, at our office address. Island Vacations is not responsible for mail directed to the individual properties.</p> <p> <strong>INTEREST BEARING ACCOUNT:</strong> Deposits and prepaid rents may be placed in an interest-bearing account.  It is understood that interest earned on these funds will accrue to the benefit of Island Vacations.</p> <p> <strong>RADON GAS:</strong> Radon is a naturally occurring radioactive gas that may present health risks to persons who are exposed to it over time when it has accumulated in a building in sufficient quantities.  Levels of radon that exceed federal and state guidelines have been found in buildings in Florida.  Additional information regarding radon and radon testing may be obtained from your county public health unit.</p> <p> <strong>INDEMNIFICATION AND LIMITS OF LIABILITY: </strong>The undersigned acknowledges that the property is privately owned and Island Vacations, or the owner and its agents (the Owner), reserves the right to refuse service to the undersigned or any guest of the undersigned. Management reserves the right to enter and inspect the property at reasonable times during the day, with or without notice.  Neither Island Vacations nor the Owner will be responsible for loss of property in any form and will not be responsible for any action of any third-party, including theft or vandalism of vehicles or property of the undersigned or any guest thereof. The undersigned agrees to indemnify and hold Island Vacations and the owner harmless from any and all costs, expenses, attorney’s fees, liabilities, damages or claims for damages, including, but not limited to, those arising out of any injury or death to any person or loss or damage to any property while renting the property.  The undersigned acknowledges and agrees to be legally responsible for all costs associated with the enforcement of this contract.</p> <p>If the terms and conditions in this agreement are not acceptable, you may contact Island Vacations to discuss or inquire.</p> <p><strong>All Information herein is subject to change without notice.</strong></p>
